Return & Refund Policy
Effective Date: January 1, 2020
Because Lady Liberty Gunsmithing LLC operates within a highly regulated industry, all transactions must comply with the Gun Control Act (GCA), the National Firearms Act (NFA), and all applicable ATF regulations including, as well as all relevant New Jersey state laws, including but not limited to NJSA 2C:39, NJSA 2C:58, and associated NJAC firearms regulations.
Accordingly, ALL SALES ARE FINAL.
No refunds, returns, or exchanges will be issued under any circumstances, except where specifically required by federal law.

1. All Firearm Sales Are Final (Federal Compliance)
Under 18 U.S.C. § 921–931 (Gun Control Act) and ATF policy, firearms cannot be returned once they have been:

Transferred to the purchaser through an FFL
-
The ATF Form 4473 and NICS background check are completed and approved.
Once a firearm has been legally transferred to the buyer, it is considered used, and federal law does not allow it to be “returned” as new inventory.
Therefore:
✔ No refunds on firearms
✔ No exchanges or substitutions
✔ No returns after transfer
If a defect is discovered after transfer, the remedy is through the manufacturer’s warranty, not the dealer.
2. NICS Denials or Delays (Federal Requirement)
Federal law requires that a firearm cannot be transferred to anyone who fails a NICS check.
If a customer:

Fails a background check
-
Refuses to complete ATF Form 4473
-
Provides false information
-
Is delayed indefinitely and chooses to cancel
The sale is still final.
Refunds cannot be issued for NICS denials, failed transfers, or buyer ineligibility.
The firearm will be retained or restocked according to federal regulations, and all payments remain non-refundable.
3. Serialized Parts & Regulated Components
Under ATF definitions, the “firearm” includes:

Frames
-
Receivers
-
Serialized components
-
NFA-regulated items (where applicable)
These items are not eligible for returns or refunds for any reason, including:

Buyer’s remorse
-
Wrong caliber or incorrect order
-
Incompatibility issues
-
Change of preference
Once purchased, all serialized items are final sale.
4. Ammunition, Magazines & Components
For safety and regulatory reasons:

Ammunition cannot be returned (ATF safety guidance + liability restrictions).

Opened or installed magazines or parts cannot be returned.
-
Any item showing signs of use or installation is non-returnable.
5. Gunsmithing, Custom Work & Labor Charges
All gunsmithing services are non-refundable, including:

Diagnostics
-
Installation
-
Repairs
-
Modifications
-
Optic work
-
Cleaning
-
Custom builds
-
Parts fitting
-

Once labor has been performed or a service has begun:
✔ No refunds
✔ No cancellations
✔ No chargebacks
If an issue arises directly from the work we performed, we may inspect and correct the issue at our discretion — this does not constitute a refund.
5A. Training Classes, Courses & Instruction (Refunds & Cancellations)
All payments for firearms training, safety courses, certifications, and instructional sessions provided by Lady Liberty Gunsmithing LLC are 100% non-refundable.
This includes:

CCW (Carry) classes
-
Firearms safety courses
-
Private instruction
-
Group classes
-
Specialty or advanced training
-
Rescheduled or postponed classes
-
No-shows or late arrivals
-
Student cancellations for any reason
Because training requires advance scheduling, instructor time, resource allocation, and in some cases legal certification requirements:
✔ Absolutely no refunds will be issued for training
✔ The customer is responsible for attending the class they enrolled in
✔ Failure to attend does not qualify for a refund or credit
If a student is removed from a class due to:

Unsafe behavior
-
Violation of range rules
-
Being under the influence
-
Disruptive conduct
-
Failure to follow instructor directions
The student forfeits all fees paid and will not be issued a refund or reschedule.
If Lady Liberty Gunsmithing LLC must postpone a class for safety, weather, or instructor availability, the class will be rescheduled, but no refunds will be issued.
6. Special Orders & Custom Requests
Special orders, custom parts, or items ordered specifically for a customer are:

Paid in full upfront
-
100% non-refundable
-
Non-cancelable, regardless of manufacturer delays or backorders
These items cannot be returned to suppliers under federal restrictions, so all sales remain final.
7. Defective or Damaged Items
If an item is defective, the customer must use the manufacturer’s warranty, per federal industry practice.
Lady Liberty Gunsmithing LLC does:

Assist with warranty processing when possible
-
Not replace defective items
-
Not issue refunds for manufacturer defects
-
Not accept returns on defective items
This preserves federal compliance and manufacturer liability.
8. Shipping & FFL Transfers
Lady Liberty Gunsmithing LLC does not ship directly to customers.
We only ship firearms to licensed FFL dealers with valid documentation, as required by federal law (27 CFR § 478).
Shipping fees (if applicable) are:

Non-refundable
-
Not covered by warranty issues
-
Not reimbursed due to FFL refusal, denial, or customer ineligibility
9. Customer Responsibility
Before purchasing, the customer is responsible for ensuring:

They are legally able to possess the item
-
The item fits their intended firearm or use
-
They understand all specifications
-
They comply with federal, state, and local laws
Mistakes in ordering, misunderstanding specifications, or finding a lower price do not qualify for refunds.
10. Chargebacks & Fraud
Any chargeback attempt on a final-sale firearm, service, or gunsmithing charge will be:

Reported as attempted fraud
-
Pursued legally
-
Supported by ATF-compliant documentation, including 4473 records (not shared publicly)
All sales are thoroughly documented and protected under federal law.
